Terms of Service

Welcome to Respec. These Terms of Service (the “Terms”) are a contract between you and Respec (“we,” “us”) governing your use of our website and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Respec builds and the marketplace
Respec offers its own custom-built PCs on pages that clearly identify Respec as the builder. Respec may also operate a separate marketplace venue where individuals list, find, and message each other about used PCs and related hardware. For those user-listed marketplace items only, We are not a party to any transaction between users. We do not own, ship, or take payment for items listed by users. Any such sale is solely between the buyer and seller.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your account credentials secure and for all activity under your account.
3. Payments
When secure checkout is offered for a first-party Respec build, payment is processed by Stripe under the order terms presented before checkout. Respec does not receive your full card number. Payments for user-listed marketplace items still happen directly between the buyer and seller; Respec does not hold marketplace funds or provide marketplace escrow.
4. Verification and “verified” listings
Some listings show a verification badge describing checks a reviewer performed (for example, a photo review, a system capture, or a benchmark). Each badge describes only what was actually reviewed and nothing more. A badge is not a warranty, certification, guarantee of working condition, or endorsement, and “As-Is” listings are not confirmed to work at all. You are responsible for satisfying yourself about an item’s condition before buying.
5. Marketplace sales are between users
Sales of user-listed marketplace items are between the buyer and seller and, unless that seller states otherwise in writing, are final and As-Is. Respec does not provide a warranty, return, refund, or buyer-protection program for a user-listed item. This paragraph does not apply to a first-party Respec build.
6. First-party build orders
A first-party Respec build is governed by the separate Build Order Terms, which cover sales, cancellation, returns, shipping, local pickup, and the written warranty. Where those terms conflict with these Terms for a build order, those terms control.
Secure checkout for first-party builds is activated only after those order terms are published in final form. Until then, sending a build inquiry is not a purchase and does not authorize a charge. The configuration, fulfillment method, price, applicable tax, and controlling order terms shown before payment form part of any accepted build order.
7. Your responsibilities and prohibited conduct
You agree not to use the Service to:
- list or sell stolen, counterfeit, relabeled, recalled, or otherwise unlawful items, or items you do not have the right to sell;
- misrepresent an item, its condition, its history (including mining or repair history), or yourself;
- harass, defraud, threaten, or harm another user, or solicit payment off-platform under false pretenses;
- violate any law, infringe intellectual-property or privacy rights, or post malware, spam, or unlawful content; or
- scrape, overload, reverse-engineer, or interfere with the Service.
8. Marketplace safety at meetups and in shipping
Meeting strangers and shipping valuables carry inherent risk. Where we suggest meeting at a public spot, that means a venue we believe is reasonable for a meetup, not a place we secure, supervise, vet, or monitor. You meet and transact entirely at your own risk. We do not screen users and make no representation about any user, item, or location.
9. Disclaimers
The marketplace Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any user listing, user, marketplace item, or verification is accurate, lawful, or reliable. Any written warranty selected for a first-party Respec build is governed by its separate order terms.
10. Limitation of liability
To the fullest extent permitted by law, Respec will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of a transaction between users, an item’s condition, a meetup, shipping, or your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred U.S. dollars ($100).
11. Indemnification
You agree to indemnify and hold Respec harmless from any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your listings, your transactions with other users, your content, or your violation of these Terms or any law.
12. Accounts and termination
We may suspend or terminate any account, and remove any listing or content, at our discretion, for example for suspected fraud, abuse, or a violation of these Terms. You may stop using the Service and request account deletion at any time (see the Privacy Policy).
13. Changes
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continued use after changes means you accept the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State in which Respec is organized, without regard to conflict-of-laws rules. Any dispute between you and Respec relating to the Service will be resolved in the state or federal courts located there (or, where we both agree, by binding individual arbitration), and you waive participation in any class action.
